Nirbhaya’s Lawyer Represents Hathras Gang Rape Victim, FSL Report Said No Sign Of Intercourse

The Delhi gang rape case in 2012 is one of the most serious crimes in the Indian history. It took an unusually long period of time to claim justice back for the victim, in which the contribution of lawyer Seema Kushwaha is undeniable.
This year, after the four accused in Nirbhaya case were hanged, the dedicated lawyer one more time represents Hathras gang rape victim to fight for her justice. Her family has also allowed Mr. Kushwaha to fight in the court on their behalf.
In fact, lawyer Seema Kushwaha has been regularly contacted the unfortunate Dalit family after the victim’s death at Safadrjung Hospital last week. He actively offered help to the family who didn’t feel safe in the village. Kushwaha stated that it’s the duty of the Uttar Pradesh government to ensure their security.
Earlier, the family of Hathras gang rape victim said the local police didn’t help them initially. The district administrators only took action after the case was brought to the public. The case also provoked massive protests across the state and some other areas in India, asking justice for the 19-year-old girl.
Meanwhile, some other sources said that the family was guided by some people to speak against the government so they refused taking the compensation from the UP government.
However, from our viewpoints, it’s hard for anyone to accept the fact that their daughter was killed but the accused didn’t face any punishment. The family might not need material compensation, they just need the proper attention from authorities who could bring justice back for their girl. That’s not to mention the family used to reveal that they were intimidated by the local administrators.
On another development, the latest report from Agra’s Forensic Science Laboratory said the samples taken from the Dalit woman didn’t show signs of intercourse. This is in parallel with the initial post-mortem report that stated the victim died of her severe neck injury.
Having said that, doubts of Hathras gang rape remain as the samples were only sent to FSL 11 days after the incident. Sperms would not be present in the samples then. Also, the victim also recorded her statements on September 22 on the hospital bed, affirming she was gang raped by the four upper-caste men on Sep 14.
On the day the victim was found, she was naked with multiple injuries on her body. And now the administration said there was no signs suggestive of intercourse. Why did the accused strip off her clothes? Suppose that they did not gang rape her, the fact that they tortured her to death and left her lifeless on the field is enough to hang all these four people.
From the bottom of our heart, we do hope lawyer Seema Kushwaha could bring justice for the Dalit woman. The journey might take another 8 years to get the accused face their punishments but it’s worth. Without it, our daughters in all over Indian states can never have confidence when stepping out.
