Sexual Assault Allegations Against Harvey Weinstein In Danger Of Collasing?

Part of the evidence accusing Harvey Weinstein of sexual harassment was abandoned after the New York Prosecutors acknowledged that one witness had been coached to keep silent on the court. The judge accepted to dismiss the accuse of Lucia Evans to Weinstein. Before then, Lucia Evans, a college student, a new actress, has accused Weinstein of forcing her to have oral sex. The accuse has raised a #MeToo movement in New York.

Weinstein's legal representative, Benjamin Brafman, failed in urging Judge James Burke to have a deep investigation in the entire case.

Until now, the Oscar winning producer has involved in five cases of sexual assault. In 2006, he involved in a forcible sex act to a woman. Next, in 2013, at Weinstein's Manhattan hotel, he sexually assaulted an anonymous woman. The other serious cases can sentence him to life imprisonment. The famous Hollywood film producer disclaims all the relating non-consensual sex accuses.

On the other side, Carrie Goldberg, the lawyer of Evan, has reported to the judiciary that Manhattan District Attorney Cyrus R. Vance Jr had rejected her client.

Goldberg emphasized that the abandonment of his client's case does not mean that Harvey Weinstein is innocent. He accused the Manhattan DA’s office of mishandling the record of Evan.

Nicholas DiGaudio, the detective accompanying with Weinstein after his arrest at the police station, has been reported having involved in the internal investigation of the police station. Therefore, he no longer has the right to involve in the case. "All allegations against Nicholas DiGaudio are important", said Chief of Detectives Dermot Shea.

DiGaudio had forced the girl coming with Evans to meet movie producer Harvey Weinstein to keep silent. The prosecutors reported that on the night she and Evans met Weinstein, they are told to expose their breast to him. At first, they declined the nonsense request. Finally, however, Evans told her that she had shown Weinstein what he wanted.

This woman also claimed that Evans would receive a role in his project if she agreed to have oral sex with Weinstein.

According to anonymous witnesses, at the time of recounting that story, Evans looked so embarrassed and upset. Also, the investigators found a letter written to Evans' husband telling of the detail in the sexual assault.

Brafman accused Evans of lying the judiciary and The New Yorker and claimed that she must receive prosecution for perjury.

In 2015, Weinstein received the accuse of grabbing the breasts of the Italian model. At that time, there was enough evidence to sentence the producer to prison but Vance rejected to prosecute him. This made the New Yorker angry.

The police reported that they had enough evidence to arrest DiGaudio. Though being release after the bailment of $1, Weinstein will have to turn up at the court on December 20.
